ARTICLE 1 – SCOPE OF APPLICATION

Any sale contracted electronically with our company MAISON MASARIN on the website www.maisonmasarin.com is subject to these general terms and conditions of sale. For any additional information, the customer can contact the Customer Relations Service at this email address: hello@maisonmasarin.com.

The website www.maisonmasarin.com is reserved for consumers. The purchase of product(s) by a professional for resale is prohibited.

Furthermore, the customer receives the information provided for in Articles L 121-18 and L 121-19 of the Consumer Code, before and after the conclusion of the sale, notably through these general terms and conditions of sale, which the customer declares to have read before confirming their order and which are accessible from the website www.maisonmasarin.com.

The photos of the items for sale on the website www.maisonmasarin.com are non-contractual and may vary slightly from the actual items.

ARTICLE 4 – PRICES AND CONDITIONS OF VALIDITY

The prices of the products sold on the website www.maisonmasarin.com are indicated per item and reference and are inclusive of all taxes (TTC), excluding delivery charges. At the time of order confirmation, the price to be paid by the customer is the total price, which includes the TTC price of the items that make up the order plus the delivery charges.

The conditions for the validity of our product offers and prices are determined by updating the website upon the release of our collections or promotions and remain applicable as long as they are accessible from our site.

The products for sale on the website www.maisonmasarin.com are available while stocks last. If one or more items ordered are no longer available, the customer will be informed by email as soon as possible. The customer will then have the option to keep the rest of their order or cancel it entirely. If the customer's credit card has been charged, the refund of the relevant amount will be credited to the bank account corresponding to the card used for payment no later than 30 days.

Discounted prices are valid on a selection of items marked on the e-boutique, while stocks last. The offer is valid only in France on the e-boutique www.maisonmasarin.com.

ARTICLE 5 – STEPS TO CONCLUDE THE SALE

  1. Add items to your cart.
  2. Fill in the order form.
  3. Check the details of your order, identify, and correct any errors made during entry.
  4. Confirm the order, the total price, and the total inclusive price by clicking on “Pay my order,” which implies acceptance of the General Terms and Conditions of Sale of Maison Masarin.
  5. Follow the instructions of our banking partner's payment server to pay for your order. Your bank account is debited with the total inclusive price, including the total price of the items shipped and the delivery charges.
  6. You will receive an acknowledgment of receipt by email, confirming your order.
  7. You will receive your package at the delivery address you provided when you placed your order.

When filling out the account opening form, providing personal data, card number, and confidential data related to it, and confirming the order, the customer agrees to comply with these contractual terms under Article 1316-1 of the Civil Code.

Maison Masarin may refuse to honor any order that appears abnormal or abusive.

ARTICLE 6 – SECURE PAYMENT

Customer purchases are paid for by credit card through our payment partner Stripe or by PayPal account.

Payment by credit card via Stripe:

It is not necessary to have a Stripe account to use this payment method.

Payment will be made from your bank card using the Stripe system, which is fully secured.

The Stripe system accepts the following cards: Visa, MasterCard & American Express.

You will need to enter your banking information on the payment interface: the 16 digits on the front of your bank card, its expiration date, and the 3-digit security code on the back.

The Stripe service will verify the transaction and then forward your payment to us. We will never have access to your banking information. This system is perfectly secure.

Payment by PayPal:

To use this payment method, you only need to use your PayPal account if you already have one or create a PayPal account.

If you wish to open a PayPal account, the opening is free and allows you to make payments securely.

Once your PayPal account is created, to pay for your order on our site, you will need to enter your PayPal email address and password when prompted. You will then be redirected to the PayPal interface, which will verify the transaction and then forward your payment to us.

We will never have access to your banking information. This system is perfectly secure.

In accordance with the provisions of Article L 132-2 of the Monetary and Financial Code, the commitment to pay by means of a payment card is irrevocable.

To this end, the customer confirms that they are the holder of the bank card to be debited and that the name on this card is indeed theirs.

ARTICLE 7 – SHIPPING AND DELIVERY

For any order placed on www.maisonmasarin.com, we commit to preparing your order within 48 to 72 working hours and within a maximum of 4 working days during peak periods (Christmas, sales, etc.).

At the time of entering the order, the customer must choose the delivery method offered on the e-boutique site and the delivery location: – Colissimo – DHL Express

In case of absence during a Colissimo delivery at the address indicated by the customer, the package will be left in the customer’s mailbox. If this is not possible, a notice of passage will be left by the carrier: the customer can then collect their package from the Post Office with a valid ID within 10 days following the date of the notice. After this period, the package will be returned to the sender, who will refund the order within 10 working days of receiving the returned package.

The customer can track the progress of their order in the "My Order" section, then "Track my order." If the order has been shipped, Maison Masarin will provide the customer with a tracking number, which they can use to track the shipment on the websites provided by Colissimo: https://www.laposte.fr/outils/suivre-vos-envois.

Each delivery is deemed to be completed once the product is made available to the customer by the carrier, as evidenced by the delivery tracking available on the Colissimo websites mentioned above.

If, 5 working days after the shipment of the package, the customer has not received any news of their order, they should contact the nearest Post Office to the delivery location. If neither the Post Office nor the delivery tracking system on the Colissimo websites mentioned above can trace the package, the customer should contact MAISON MASARIN’s Customer Relations Service at hello@maisonmasarin.com, which will then initiate an investigation with the Postal Services. The response times from the Postal Services vary from one to four weeks from the time the case is taken up by MAISON MASARIN’s services.

In case of non-delivery due to an incorrect address provided by the customer, or any other cause attributable to them (missing name on the mailbox, lack of information, etc.), the package will be returned to the sender, and the order will be refunded upon receipt.

Cases of force majeure discharging MAISON MASARIN from its obligation to deliver include, but are not limited to, war, riot, fire, flood, strikes, accidents, and impossibility of supply.

In any case, the delivery of our products on time can only occur if the buyers are up to date with their obligations towards us.

It is the customer’s responsibility to check shipments upon arrival and to make any justified reservations and claims, or even to refuse the package if it appears to have been opened or shows signs of damage. These reservations and claims must be addressed to the carrier by registered letter with acknowledgment of receipt within 3 working days, excluding public holidays, following the delivery of the products, with a copy immediately sent to MAISON MASARIN. Failure to claim within this period will extinguish any action against the carrier in accordance with Article L 133-3 of the Commercial Code.

The customer must ensure that the delivered items match their order. If the delivered items do not conform in nature or quality to the specifications indicated in the delivery note, the customer must inform MAISON MASARIN’s Customer Relations Service by email at hello@maisonmasarin.com and return the items to the address and under the conditions specified in Article 8.

ARTICLE 8 – RETURN POLICY

In accordance with Articles L 121-20 and following of the Consumer Code, the customer has a reflection period of fourteen clear days from delivery to change their mind and return the ordered item without having to justify reasons or pay penalties.

Return costs are covered by us only within mainland France.

For returns from abroad and the French overseas departments and territories, return costs remain the customer’s responsibility.

For a return from outside the European Union, you will need to pay the customs fees before shipping, otherwise your package may be returned to you, as we cannot cover these fees upon receipt.

Beyond this 14-day period, as evidenced by the postmark, your return will not be accepted.

When several items ordered on the site www.maisonmasarin.com have been shipped at once (in a single package) and the customer decides to return the items that do not suit them, all items must be returned at the same time, in one package, at our expense, otherwise, the return cannot be accepted.

Beyond the legal withdrawal period of 14 days, Maison Masarin grants you 15 days to return an item that does not suit you. For returns after 14 days, return costs will be at your expense and refunded upon receipt of the package by us.

Returned items must be in their original condition and complete (packaging, accessories, tags, etc.), allowing their re-commercialization in new condition, and must be accompanied by a copy of the proof of purchase. Damaged, soiled, or incomplete items will not be accepted.

The right of withdrawal may be exercised by contacting MAISON MASARIN by email at hello@maisonmasarin.com.

In case of exercising the right of withdrawal, MAISON MASARIN will refund the sums paid, within 14 days of the receipt of the items and in the same form as the initial payment. After this period, the amount due will be automatically increased by the legal interest rate.

The website www.maisonmasarin.com is the exclusive property of SARL MARLIE, in its entirety, as well as all related rights. Any reproduction, in whole or in part, is systematically subject to the authorization of the owners. However, hypertext links to the site are allowed without specific request.

ARTICLE 11 – LIABILITY

The products offered comply with current French legislation. MAISON MASARIN cannot be held liable for non-compliance with the legislation of the country where the product is delivered (e.g., in case of a product ban). It is the customer's responsibility to check with local authorities about the possibilities of importing or using the products they intend to order.

The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, MAISON MASARIN cannot be held liable for any error in one of these photographs or texts.

MAISON MASARIN cannot be held liable for breaches of contract resulting from occurrences of force majeure, in particular, in cases of total or partial strike of postal services and means of transport and/or communication, flood, or fire.

ARTICLE 12 – WARRANTY

In accordance with the law, MAISON MASARIN assumes two guarantees: of conformity and related to hidden defects of the products. MAISON MASARIN will refund the buyer or exchange the products that appear to be defective or not corresponding to the order.

ARTICLE 13 – APPLICABLE LAW AND DISPUTE RESOLUTION

These general terms and conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
